Sup fellas,
I'm trying to loose that last few pounds ready for the summer.
I'm presently doing cardio 3 times a week for around 40 mins a time. Out of interest what would my optimum heart rate be for fat burning.

How old are you? How tall are you? (feet/inches preferably) This would help determine it. ;)

Your max heart rate is 189. (220-Age). For fat burning the range is 60%-70% of your max heart rate. Therefore, the range you'd like your heart rate at is 113-132 bpm. ;)

Doesn't maximum heart rate depend on resting heart rate as well?

A persons Resting Heart Rate should certainly influence their max heart rate, but the 220-age equation is just a generalized way of finding your max hear rate.

The 220-age is an estimate ... for sedentary people.
Everything I have read suggests the level of athleticism will affect resting & maximum heart rate - and not just age.

You're correct it is a generalized way. There are ways to determine your Max VO2. A number of physical endurance tests exist...ones such as, The Astrand Cycle Test or The Foresty Service Step Test will help to determine ones Max VO2 more accurately.
