    HELP asap! - legal question, how to file a motion to object?

    "george" is in very hot water.

    he has been accused of hacking into Company A's email system. he did some project based work for them as a contractor over a year ago and had admin rights under a generic system account.


    Legal counsel of company A has subpeoned the george's ISP for his personal info. (apparently i guess they never changed the account?) some of their execs report missing emails.
    he has ONLY 3 days to file a "motion to object" or the info will be handed over.

    george is already in process of trying to contact local state court to find out how he can file this himself, because he is in process of finding a lawyer..in the meantime, what to do?


    btw, we are under california state law.

    if the subpoena(sp?) has already been served then you have 10 days to file the motion(10 court days), and thats 10 days from the date of service.

    my fiance is a paralegal, and we're in cali, so i can ask her about anything if ya need some help.

    Start re-formatting.....or installing a new hard drive.....

    Most I.S.P.'s, except for the really large ones like A.O.L., don't keep records past 30 days. Is the alleged offense within that timeframe?

    well the the isp got the subpoena from company A, dated a few weeks ago.

    george just received a notice and a copy of the subpoena from his isp today saying that if he objects, the motion must be filed 1 day prior to the "production request date". that gives only 2 days, i dont see how such short notice can be legal or a "reasonable time".

    lol yeah i already said REFORMAT, heh JK..talking like this is a guilty party - NOT!

    apparently they have logs with recent dates. other than that there's vague info on what exactly was compromised.

    they are dumbasses if they never changed their admin account and crying bloody murder looking for a scapegoat.

    i guess need a lawyer to file "formal" requests cuz they are mum with info and don't return calls.

    LMFAO maybe the best advise in this whole thread.

    This whole thing is over some missing emails? That's interesting.......laws generally don't work in favor of the little guy.....Goerge should beat feet to the nearest lawyer ASAP....and the REFORMAT probably won't do George a whole lot of good....it's more of his ISP's records......30 days? "Incremental backup" guys.....once a month....a tape goes on the shelf here ( I know because I do it)......just IN case I can't believe an ISP would do any less.....and because of such things maybe prudent to carry it out with more frequency....if George is worried about ISP records he needs a darn good lawyer and FAST!
