    Sally McNeil

    anyone here old enough to remember the Sally McNeil story? It was in Flex magazine.

    The U.S. Supreme Court reinstated the 1996 murder conviction of a former Oceanside bodybuilder who said she shot and killed her husband because he physically and sexually abused her.

    In a six-page unsigned opinion the justices overturned a ruling from the 9th Circuit Court of Appeals in September, which had thrown out the conviction of Sally McNeil.

    The appeals court determined that a four-word error in a jury instruction by San Diego Superior Court Judge Laura P. Hammes effectively wiped out McNeil's claim that she acted in self-defense and should be convicted of manslaughter, not murder.

    The appeals court concluded that the erroneous instruction conflicted with other instructions on the same topic given by the judge and created ambiguity about the law, said Deputy Attorney General Warren Robinson, who argued for the state.

    A state appeals court had considered the same argument and rejected it. That court concluded a slight error in one instruction could not be reasonably expected to mislead jurors, given all the other correct instructions on the same legal point.

    The Supreme Court agreed with the state court. In its decision the justices also said that the 9th Circuit did not give "appropriate deference" to the state court's reasoning.

    Raymond McNeil, a former bodybuilding champion, was shot to death on Valentine's Day 1995 in the apartment he shared with Sally McNeil as he prepared a chicken dinner.

    Sally McNeil shot him with a pistol-grip shotgun, hitting him in the side before firing the fatal round into his head as he crawled on his hands and knees on the living room floor.

    At the trial, Sally McNeil said that she was a battered woman who was subjected to physical and sexual abuse during a tumultuous marriage. Prosecutors presented evidence that showed that Sally McNeil was also abusive and combative to her husband and others.

    She was convicted of second-degree murder and sentenced to 19 years to life in prison.

    Thats pretty brutal;

    shure 'nuff. McNeil has contended she was a battered woman, but the claim was disallowed somehow her expert witness of BWS was that the judge told the jury to disregard it.

    Ray was unfaithful, that is for sure. If he was a batteror, the records were incomplete from the Marine Corps that would have shown medical treatment from Sally. This case has been appealed up to the Supreme Court.

    Prosecution tried to show Sally killed him for the life insurance money. However, as Sally was the breadwinner for the family, simply leaving Ray would have improved her situation. Sally had previously been in an abusive marriage, but managed to leave and divorce that husband.

    Sally doesn't fit the profile of an abused woman, as she was a bodybuilder and former Marine. The Teagan Clive article in Flex painted an unflattering picture with footnotes from the prosecution and police.

    Also, Sally wasn't a professional bodybuilder but she was in the NPC, competing in the national level shows.

    I don't care if everyone knows I am a female...read my join date. Sure I haven't been active here, but I have visited a lot of bodybuilding bulliten boards and it has been a rather interesting experience
