    Man tried for manslaughter for letting friend drive drunk.

    The man was aquited on the manslaughter charges, but the jury was hung on vehicular homicide and assault.

    Basicaly the way I understand the story is that the defendent's friend was picked up for DUI, the friend called him to bail him out the jail and the defendent then led his friend to the car, and let him drive home himself. the Friend rather than driving home, went drinking again and ended killing himself and an innocent man.

    The prosectuion, the victim's family, and MADD are pushing these severe charges against him. In my opinion the Man should not be charged with and crime because he had no legal responsiblity for his friend. The Friend was a grown man and made the bad decision to drive. It led to the tragic death of and innocent man, but the defendent has no legal right to stop his friend from driving.

    I think this is the problem.I think one of the conditions of bail is that the person posting bail is responsible for the person they are bailing out.

    hence the term " bailing out"

    So no matter what he did the person bailing him out is still responsible?
    That seems a little ridiculous to me

    The guy who posted bail.........

    drove his buddy back to his car and gave him the keys. It is illegal to knowingly allow a drunk person to operate a motor vehicle. Under the law when you allow a drunk to drive you are as responsible as the drunk himself. Since this guy knew his buddy was under arrest for drunk driving it is reasonable to assume he knew his buddy was drunk. I know this may seem harsh, but knowing this story how many of us would be stupid enough to let a drunk friend get behind the wheel?
    This is why most police departments will not allow a drunk to post bail until they are sober. I do believe that the P.D. is also looking at a very hefty law suit from the families for letting this guy go to soon.

    Of course the friend is responsible. If the guy was locked up, there's a reason. When you bail someone, you're in essence saying "They don't need to stay here, I'll take care of them." If you don't take care of them, you are shirking your legal responsibility. The guy should have been charged and convicted of negligent homicide. How bout if that was your family that got hit by that drunk? Wouldn't you wanna just beat the **** out of that ass that bailed the guy out then got his ass back in a car?
