    If my car gets broken in to at a repair shop do I have to pay

    I dont no if you read my last post but I just dropped my car off yesterday for another trans repair. Well last night the damn thing got broken into. In the window was broken and nothing is missing. I dont want to pay for this they all ready had it and was working on it. They had room in the garage and never put it inside. And I have teo alarms a factory and a after market. If they had used my aftermarket the red light would have blinked and this would not have happend. They just use the factory which makes the horn hunk. But no indicator light thats why the broke the windwo but since there is a 30 second delay they were scard off after they were in my car. I dont want to pay for this. Advice please.
    Age 23 Height 5'10 weight 210 2 years complete of serious lifting.
    At 5'10" last Jan/02 I was 280 Lbs with a 44 waist.
    Now as of Dec/02 I am 210 with a 34-36 waist. A year complete 70 pounds lost now lets get big .

    I havent talk to them yet this morning but last night the owner suggested my insurance pay for it. He said he will try to get a windwow in but then mentioned my insurance again.

    You should contact a lawyer. They should be liable for your car while it was on there property. But I know they is something about if a merchant deals with the type of property in the ordinary course of business that was stolen or damaged they may not be liable; Itís the gray area.

    Damn... this is a bailment case in business law but I cant quite remember how the rules go. I think, since you had it there to be repaired, that they have to exercise reasonable care with it. Couple things that might help your case:

    1) If they knew about the after market alarm but didnt use it
    2) If they had room for the car inside, but left it outside anyway

    Definately ask them first, maybe they will cover it.

    Y2A, the repair shop must exercise "ordinary" care becuase both bailor and bailee benefit.

    If you check most all shops I know are not liable for such things as breakins etc.....however it is an insurance thing and I wouls see if his would pick it up, first. It never hurts to ask. However prepare for it to be your cost to pick-up. You can get a window much cheaper than your $500 deduct. btw, I would lower your deduct to $250, for this very reason......I know it raies your monthly but only a fraction....

    I've been stuck like this before - my car stereo face was stolen at a garage but there was a disclaimer at the bottom of the job sheet that I'd signed stating:

    "The garage holds no responsibility for damage or loss to any car or its contents whilst left in the garages care, provided suitable precautions have been made to secure the vehicle"

    So I got nout

    You might bo ok though - check to see if you signed anything when taking it in, or if their was a disclaimer anywhere.

    Thats just it, if they had the room and ability to keep the car inside and didnt, then were "suitable precautions to secure the vehicle" made?

    hey gues what the owner had came there that night to meet me. the cops called him to. He had to come to put my car in the garage I did not have the key. Yes there was plenty of room the first bay was empty and he never used my other alarm. They said they will have the window replaced today or maybe tomrow but said not sure if it will be coverd. this is COTTMAN TRANSMISION if any one is curios.

    Ouch, if he tried to put the car inside and you didnt have the key... I would say that he did his part and he is probably not responsible

    Thatís a standard exculpatory clause and would be ignored by any judge. The garage was liable for your radio, and should have replaced it.

    I've always had the 500 deductible. I guess I don't know the numbers but I bet its more then a fraction to difference.

    Your probably screwed. I am pretty sure the policy is its your problem. They can't be responsible if someone wants to break in your car. Ya they should have put it in the shop, but don
    t have to. Your insurance company will tell you is gonna pay, they don't want to if they don't have too. But then you get them envolved for a minor item, which could cost you more in increased premiums. Insurance people are on my list.

    I'd probably still make the balls big, if they want your bussines bad enough they'll do it. Also there repuation. It would probably help if you were older and driving something expensive though.

    haha, I thought at first this was going to be a thread about waht would happen if a repair guy stole stuff from your car whilst working on it.. A couple years ago a repair guy was messing with my stereo, I found out which one it was form the manager and threatened him to within an inch of his life, worked wonders

    As far as liability goes, if theres not a sign up saying "Not responsible for damages incurred while your vehicle is on our lot" or whatever, then I'd press the matter a bit, nicely. Doesn't hurt to ask, and be a bit forceful with your ideas.
